Terms & Platform Rules

1. Introduction

Welcome to NYBO. These Terms & Platform Rules govern your access to and use of our website, platform, and related services.

NYBO is a local neighbour-to-neighbour rental marketplace. We help users list, discover, request, and arrange the rental of items with other users. By using the platform, you agree to these Terms & Platform Rules.

If you do not agree to these terms, you must not use the platform.

2. Our role

NYBO provides a platform that allows users to connect with each other for local item rentals. Unless we expressly state otherwise, we are not the owner, manufacturer, reseller, repairer, insurer, or direct supplier of listed items.

We act as an intermediary platform. The rental contract for a listed item is made between the lender and the renter. We may facilitate communication, trust features, identity checks, payments, dispute handling, and certain platform protection processes, but this does not mean we become a party to every rental agreement.

3. Eligibility

To use the platform, you must:

  • be at least 18 years old;
  • have the legal capacity to enter into a binding agreement;
  • provide accurate and complete information;
  • comply with these Terms & Platform Rules and all applicable laws.

We may refuse access, request additional verification, or suspend accounts where we believe eligibility requirements are not met.

4. Account registration and verification

You may need to create an account to list or rent items. You agree to keep your account details accurate, current, and secure.

We may require email verification, phone verification, payment verification, identity verification, address confirmation, or additional checks for higher-risk accounts, higher-value items, suspicious behaviour, repeated disputes, or legal/compliance reasons. Failure to complete required checks may limit your access to certain features or result in suspension.

You are responsible for all activity that takes place under your account unless you promptly notify us of unauthorized use.

5. Platform rules

Users must act honestly, respectfully, and in good faith when using the platform. In particular, you must not:

  • provide false, misleading, or incomplete information;
  • impersonate another person or misrepresent ownership of an item;
  • attempt to move transactions off-platform in order to avoid fees, platform checks, or platform rules;
  • upload fraudulent evidence, false damage claims, or manipulated photos/videos;
  • use the platform for illegal, unsafe, harmful, abusive, or deceptive purposes;
  • interfere with platform security, payment flows, verification systems, or dispute processes.

We may investigate suspected misuse and take action including warnings, listing removal, payment holds, account restrictions, suspension, or permanent removal.

6. Listing rules for lenders

If you list an item on the platform, you agree that:

  • you have the right to list and rent out the item;
  • the listing is accurate, complete, and not misleading;
  • the item is safe, lawful, and in a usable condition unless clearly described otherwise;
  • photos, videos, serial numbers, accessories, and condition details are truthful;
  • you will disclose relevant limitations, defects, handling requirements, or safety risks;
  • you will make the item available as described and at the agreed time;
  • you will not list prohibited or restricted items.

Lenders are responsible for maintaining their items, checking condition before handover, and complying with any applicable legal, tax, safety, or insurance obligations connected to the item or rental activity.

7. Rules for renters

If you rent an item through the platform, you agree that you will:

  • use the item lawfully and with reasonable care;
  • follow any instructions, safety warnings, or agreed limitations;
  • return the item on time and in the same condition, subject to fair wear and tear where applicable;
  • not lend, sub-rent, resell, alter, dismantle, or misuse the item without permission;
  • report any loss, malfunction, damage, accident, or delay promptly and honestly;
  • cooperate with any evidence or dispute process.

Renters are responsible for loss, damage, missing parts, late return charges, misuse, and any costs properly arising from a breach of these rules.

8. Prohibited items

The following categories must not be listed unless we expressly allow them in writing:

  • illegal items or stolen goods;
  • weapons, ammunition, explosives, fireworks, or hazardous materials;
  • counterfeit goods or items that infringe intellectual property rights;
  • drugs, controlled substances, or paraphernalia;
  • unsafe electrical items, defective equipment, or recalled products;
  • medical devices, prescription items, or regulated products where listing would be unlawful;
  • animals, personal services, or items whose rental would breach law or public safety;
  • any item we reasonably consider inappropriate, dangerous, or high-risk for the platform.

We may remove listings at our discretion where safety, legality, trust, or operational concerns arise.

9. Pricing, fees, deposits, and payments

Lenders may set rental prices, subject to any platform rules or category limits we may introduce. Renters may be charged:

  • the rental price;
  • service fees;
  • applicable deposit or payment authorisation amounts;
  • late fees, damage-related charges, or other amounts permitted under these terms and the applicable booking rules.

Where payments are processed through a payment provider, users agree to comply with that provider's terms. We may delay, hold, reverse, or refuse transactions where fraud, error, chargeback, misuse, legal risk, or dispute concerns arise.

Any protection-related fee, reserve contribution, or similar amount charged through the platform is not a guarantee of full insurance coverage unless we expressly state otherwise in writing.

10. Handover, return, and evidence

Users must follow the applicable handover and return process for the category and value of the item. This may include photos, videos, condition checks, accessory checklists, timestamps, collection notes, or serial number confirmation.

We may require higher evidence standards for higher-value, higher-risk, or more dispute-prone items. Failure to provide required evidence may affect eligibility for platform support, dispute review, or recovery.

11. Damage, delay, loss, and disputes

Damage, missing parts, non-return, late return, incorrect item condition, and similar issues are handled under our Protection & Disputes rules, as updated from time to time.

Users must report relevant issues within the stated reporting window and provide reasonable supporting evidence. Failure to report in time or provide required information may limit or prevent a claim, review, or appeal.

We may review evidence, request further information, determine outcomes, facilitate refunds or charges, and apply platform decisions in accordance with our stated rules and internal processes.

12. Safety and liability

Users are responsible for acting safely and using appropriate care when listing, collecting, handing over, transporting, or using items.

To the fullest extent permitted by law:

  • users accept that item rental involves practical risks;
  • the lender is responsible for accurately describing the item and not knowingly supplying an unsafe item;
  • the renter is responsible for proper handling and lawful use of the item;
  • NYBO is not responsible for injury, damage, loss, delay, indirect loss, or consequential loss arising from user conduct, item misuse, inaccurate listings, unsafe handling, third-party acts, or matters outside our reasonable control.

Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Consumer and business seller status

Some listings may be offered by private individuals and others may be offered by businesses. Consumer law protections may differ depending on whether the seller or lender is acting as a business or as a private individual.

Where relevant, we may ask users to indicate whether they are acting as a consumer, sole trader, company, or other business user. Users are responsible for providing accurate status information.

14. Ranking and visibility

Search results, listings, and recommendations may be displayed or ranked based on factors such as relevance, distance, availability, listing quality, trust signals, responsiveness, evidence quality, profile completeness, recent activity, user experience, or platform safety considerations. We may also highlight certain listings, categories, or trusted users using badges or similar features.

We may change ranking logic from time to time to improve relevance, safety, fairness, and platform performance.

15. Platform actions and enforcement

We may take action where we believe it is necessary to protect users, comply with law, reduce fraud, maintain trust, or enforce these terms. This may include:

  • removing or hiding listings;
  • cancelling or restricting bookings;
  • withholding payouts;
  • requesting additional verification;
  • limiting account functionality;
  • suspending or terminating an account.

Where appropriate, we may explain the main reason for serious enforcement action, but we are not required to disclose information that would undermine fraud prevention, legal obligations, security measures, or the rights of others.

16. Intellectual property and content

Users remain responsible for the content they upload, including listings, photos, videos, descriptions, and messages. By uploading content, you confirm that you have the right to use it and grant us a non-exclusive right to host, display, reproduce, adapt, and use that content for operating, improving, and promoting the platform.

We may remove content that breaches these terms, infringes rights, creates legal risk, or harms trust in the platform.

17. Tax and legal compliance

Users are responsible for their own tax, reporting, licensing, and legal obligations arising from listing, renting, or earning income through the platform.

Where required by law, we may collect, retain, verify, or report user or transaction information to relevant authorities, including tax or regulatory authorities.

18. Changes to the platform and terms

We may update these Terms & Platform Rules from time to time. If we make material changes, we may notify users through the website, by email, or through the platform interface. Continued use of the platform after updated terms take effect means you accept the revised terms.

19. Suspension and termination

You may stop using the platform at any time. We may suspend, restrict, or terminate your access where:

  • you breach these terms;
  • you create fraud, safety, legal, or reputational risk;
  • verification fails or remains incomplete;
  • we are required to do so by law or regulatory instruction;
  • continuing the relationship is no longer operationally or legally appropriate.

Termination does not affect rights or obligations that arose before termination.

20. Governing law

These Terms & Platform Rules are governed by the laws of Ireland, unless applicable mandatory consumer law requires otherwise.
